How Are Attorneys Working with Expert Witnesses?

Earlier this year, ECS conducted a survey to identify perceptions about expert location services and how legal professionals, namely attorneys, are approaching and working in this market. We have noticed an increase of expert witnesses playing pivotal roles in the courtroom, and saw an opportunity to discuss the topic with the men and women on the front line. Our goal was to understand where, when, and how attorneys source their expert witnesses and how this affects their case preparation.

In our anonymous survey, 90 attorneys shared their experience, which can help us gain insight into how they work with expert witnesses, their process for locating the best experts for a case, and what challenges they have had working with experts in the past.

We wanted to know:

  • How often attorneys hire an expert witness and how they find them
  • At what point attorneys bring an expert onto the case
  • Who is typically responsible for locating an expert witness
  • If attorneys have a hard time locating the right expert
  • If an expert witness ever misrepresented their qualifications to the hiring attorney
  • If attorneys incur fees for finding experts
